Study Shows that Meditation helps Boosts Immunity

• In the times of COVID-19 pandemic, Heartfulness Meditation can help build a layer of protection with improved immunity

Hyderabad, 8^th July 2020: Heartfulness Meditation, a meditation practice adapted from Raja Yoga system, improves immunity against infections and cancer and is an effective adjunct in the treatment of several autoimmune disorders. In the current context of COVID 19 Pandemic, given the lack of vaccines available it has been advocated strongly by medical and other research fraternities that the fundamental defence against the virus is to have strong immunity.   

In an article published in the International Journal of Recent Scientific Research, authors Dr. Raja Amarnath G. Director, Critical Care Services - Sree Balaji Medical College, Chennai, Dr. Natwar Sharma, Pediatrics In charge - Saveetha Medical College, Chennai Dr. Prasanthi J., Diabetologist, Chennai, Dr. Sugirtha Jenitha, Critical Care - Sree Balaji Medical College,  Dr. Chitra Rajan Consultant Environmental Sustainability - IIT Chennai and Dr. Subbulakshmi Balasubramanian, RRT, Michigan USA have drawn a comparison between stress and immunity.

Commenting on the far reaching benefits of meditation Mr.Kamlesh Patel, Guide of Heartfulness said, “meditation should be made an integral part of life, it  acts as a silent regulator for all systems in our being – physical, mental, emotional and spiritual to function in harmony. The impact of this is the ability of the body and mind to respond to internal and external stress with extreme effectiveness. Scientific backing forms the core of the offerings at Heartfulness. According to the authors, when stress becomes chronic, many organ systems in the body are affected. Persistent stress results in excessive levels of cortisol and other corticosteroids circulating in the blood for a longer period that produces irregularities in the immune responses. This results in increased susceptibility to infections, increased risk of cancer, tendency to develop an allergy, increased gastrointestinal problems and an increased risk of autoimmune disorders. Chronic stress also leads to anxiety, depression, sleep deprivation, hypertension, cardiovascular diseases, diabetes, and metabolic syndrome.  

The authors stress that managing stress through relaxation techniques, meditation, yoga, positive thinking and moulding a healthy lifestyle can dramatically improve mood and strengthen the immune system. They cite several studies, Studies revealed that the relaxation produced after meditation reduces the levels of IL-6, a proinflammatory cytokine produced by T cells, that plays a major role in the pathophysiology of several autoimmune diseases, different types of cancers and Alzheimer’s diseases. 

According to them, meditation increases telomerase activity and lengthens telomeres and thus promotes immune cell longevity. Beneficial effects of meditation also include reducing the activity of nuclear factor-kB (NF-kB) which is a mediator in the pathogenesis of certain cancers, arthritis, chronic inflammatory conditions, asthma and neurodegenerative diseases and lowering C - reactive protein levels that are high in lymphoma, systemic lupus erythematosus, arthritis, rheumatoid arthritis and inflammatory bowel disease.

Regular practice of Heartfulness Meditation can aid in stress reduction and general well-being. Shifting the autonomic balance towards parasympathetic from sympathetic and reducing the secretion of stress hormones are the key reasons. Relaxation response produced from meditation reduces metabolic rate, moderates fight or flight response, reduces breathing and heart rate (HR), lowers blood pressure, brings cortisol and lactate levels down, and elevates blood flow to the key internal organs. Heartfulness Meditation alleviates physical and psychological stress and restores mental harmony, and if practised regularly – it is a remarkable medium for maintaining and promoting physical, mental, and spiritual health.

E-contracts should comply with relevant laws to be legally enforceable

COVID 19 pandemic is accelerating the adoption of digital technologies across all sectors, viz. education, healthcare, financial and legal services. Digitization is gaining traction even in the field of contract enforcement, with companies, government departments, financial institutions and other entities increasingly opting for paperless mode of entering into agreements.

In an interview to MVIRDC World Trade Center Mumbai, Ms. Gautami Raiker, Founder of the Goa-based law firm LawMate.in shares useful information about digital contracts. Ms. Raiker is also the Director and CEO of The Legal Capsule, which assists enterprises in digitizing their contracts. Ms. Raiker cautions that digital contracts or e-contracts will be legally binding and enforceable only if they comply with the provisions of Indian Contract Act, 1872 and the Information Technology Act, 2000.

Ms. Maithili Chodnekar, Chief Legal Officer (CLO) of the Legal Capsule also contributed her perspectives to this interview.

Excerpts of the interview:

1. Many of our MSME members are eager to know how they can access bank loans through video KYC, Aadhar-based KYC and online authentication channels. Can you explain the RBI's regulation and procedures involved in these modes?

The Covid19 pandemic has transformed the way the Government Departments, Banking Institutions function. There has been a recent clarification from Securities Exchange Board of India (SEBI) dated April 24th, 2020. SEBI held discussions with various market participants and based on their feedback and with a view to allow ease of doing business in the securities market, it has been decided to make use of technological innovations which can facilitate online KYC.

Moreover, with a latest guideline circular from the National Payments Corporation of India dated 26th May 2020 which mandates all NACH enabled Banking Institutions to use KYC and e-signature for loans and other insurance products. This will surely be a complete digital revolution in the financial sector enabling MSMEs to apply for loans or insurance products online.

The circular by SEBI has mentioned about e-signature using Aadhaar. It is pertinent to note that citizens including MSMEs can now sign digitally using Aadhaar card having registered mobile number that generates OTP and impresses sign on the document. This meets the criteria and is legal as per the Information Technology Act, 2000. MSMEs can be ensured to even enforce documents that are digitally signed using Aadhaar in the court of law.

2. How can manufacturing companies, service providers and government contractors benefit from the provisions of the Information Technology Act 2000 (IT Act), which provides legal recognition to electronic records?

• The IT, Act 2000 empowers government departments to accept filing, creating and retention of official documents in the digital format. It has also proposed a legal framework for the authentication and origin of electronic records/communications through digital signature.
• From the perspective of e-commerce service providers in India, emails would now be a valid and legal form of communication that can be duly produced and approved in a court of law.
• Companies shall now be able to carry out electronic commerce using the legal infrastructure provided by the Act.
• IT Act, 2000 Act now allows Government to issue notification on the web thus heralding e-governance.
• The Act enables the companies to file any form, application or any other document with any office, authority, body or agency owned or controlled by the appropriate Government in electronic form by means of such electronic form as maybe prescribed by the appropriate Government.
• The IT Act also addresses the important issue of security, which are so critical to the success of electronic transactions. The Act has given a legal definition to the concept of secure digital signatures that would require to have passed through a system of a security procedure, as stipulated by the Government at a later date.

• Under the IT Act, 2000, it shall now be possible for corporates to have a statutory remedy in case if anyone breaks into their computer systems or network and damages or copies data. The remedy provided by the Act is in the form of monetary damages, not exceeding Rs. 1 crore.

3. Apart from loan contracts, what are the other contracts that can be entered into digitally and which are legally enforceable? What are the precautions to be taken by the contractual parties while entering into such digital contracts?

• Commercial agreements between corporate entities, including (Non Disclosure Agreements (NDAs), procurement documents, sales agreements
• Consumer agreements, including new retail account opening documents
• Certain forms of real estate documents, such as certain lease agreements, purchase and sales contracts, and related documentation for residential and commercial real estate
• HR documents, including employment contracts, paperwork and other new employee onboarding processes

Digital Contracts are regulated by the provisions of both Indian Contract Act, 1872 and the Information Technology Act, 2000. Every e-contract, therefore, needs to comply with the provisions of these Acts to make them legally binding and enforceable.

Essential elements of a valid e-contract:

• Offer and Unconditional Acceptance - Which may be made online or by e-mail communication.
• Lawful Purpose and Consideration - A contract is enforceable by law only when it is made for a lawful purpose and for some consideration. It must not defeat any provision of law and must not be fraudulent in nature.
• Capacity of Parties and Free Consent - Parties to a contract are capable of entering into a contract, if they satisfy the requirements of Section 11 and 12 of the Indian Contract Act, 1872 (capacity to contract), and consent of the parties must be free as per Section 13 of the Indian Contract Act, 1872.

As per Section 2(a) of The Indian Contract Act, 1872, which defines the term ‘offer’, states that an offer must be communicated to the offeree. The terms of the contract cannot be changed after the approval and acceptance of the recipient has been given and communicated.

Any changes if made should specifically and exclusively be communicated to the recipient.

4. Many of our members are exporters, importers, tour operators and software service providers, who deal with overseas clients. How can our members enter into e-contracts with foreign clients? What is the relevant jurisdiction for enforcement of cross-border contracts? Are these contracts enforceable under the Information Technology Act and the Indian Evidence Act 1872?

The place of contract in an e-contract for the purposes of determining jurisdiction (i.e., the place where the cause of action arose) would be deemed to be where the originator has his place of business and where the addressee has his place of business. However, since Section 13 of the IT Act is subject to the mutual agreement of the contracting parties with respect to the agreed place of contract, it is recommended that all parties in their electronic contracts provide for a specific clause on jurisdiction to avoid future conflicts on jurisdictional or choice of law issues.

5. What are the uses of Digital Signature Certificates (DSC)? What is the procedure for getting this certificate and who are the Certifying Authorities (CAs)?

Use of DSC:

Digital Signature Certificate helps achieve three most important goals of Information Security: Information, Authentication, Non-Repudiation.

A DSC authenticates your identity electronically and provides high level security for online transactions by ensuring absolute privacy of any information that you exchange using Digital Signature Certificate. If you use a DSC to sign information/document, the recipient is assured that it has not been changed in transit and it also verifies your identity as the sender of the information/document, which in other words means that Only the intended recipient will be able to read the information/document as your DSC can be used for encrypting information.

Procedure for obtaining DSC:

• STEP 1: Log on and select your type of entity

               Log on to the website of a Certifying Authority licensed to issue Digital Certificates in India.

Once you open the page, you will be guided to the Digital Certification Services’ section.

Now under the ‘Digital Certification Services’ section, click on the type of entity for which you want to obtain the DSC:’ individual or organization’, etc.

In case you are applying for an individual DSC, click on ‘individual’. A new tab containing the DSC Registration Form will appear. Download the DSC Registration Form on your PC.

• STEP 2:

Fill in the necessary details.

After filling up all the necessary details you must affix your recent photograph and put your signature under the declaration. Check thoroughly for completion of the form. Take a print of the completed form and preserve it.

COVID 19 to hit Sony Corp’s operating profit

COVID pandemic has affected discretionary consumption and sale of consumer durable goods such as television, mobile phones, air conditioners, digital cameras etc. across the world.

Japanese conglomerate and the world’s leading electronic goods maker Sony Corp. warned that this crisis may reduce its operating profit by 30% or more in the current year.

The pandemic has affected production and sale of the company’s smart phones, digital cameras and other electronic products.

The company sounded the note of caution as it reported operating profit of 35.45 billion yen (USD 33 million) for the quarter ended March 31, 2020, down 57% from the same period a year earlier. Revenue also fell to 1.75 trillion yen.  Forecast for the current year was not available.

Sony warned of unusual uncertainty because of the pandemic effect on production and demand. Based on its best assumptions now, operating income for the fiscal year ending March 31, 2021 is currently estimated to be at least 30% lower than the level achieved in the previous fiscal year.

The virus is impacting operations in unusual ways. According to Sony, its most affected unit is consumer electronics, with disruptions hitting factories that make televisions in Malaysia, Mexico and Slovakia, although they have resumed partial operations. Television sales have also slumped especially in Europe, India and Vietnam, while demand for digital cameras has decreased. The flagship gaming business said play station  4 console sales declined 42% to just 1.5 million units in the quarter, partially because of the widely anticipated launch of successor play station 5 at the end of the year.

COVID -19 may have a lasting impact on markets such as Brazil, India and Southeast Asia because it could reduce demand for consumer electronics, movie theaters and music concerts, according to an analyst.

MSME Minister urges industries to tap opportunities created after COVID 19

 

Union Minister for MSME and Road Transport and Highways Shri Nitin Gadkari has said that industries should keep a positive outlook and tap the opportunities that may arise after COVID 19 pandemic is over.

Shri Gadkari called upon the industry that it is needed to be ensured by industries that necessary measures are taken to prevent the spread of COVID 19 and that all stakeholders must adopt an integrated approach to overcome the crisis while ensuring the lives and livelihood of the people.

The Minster emphasized that special focus towards export enhancement is the need of the hour.  There is also a need to focus on Import substitution to replace imports with domestic production.

According to Shri Gadkari, the Government of Japan has offered special package to its industries for withdrawing Japanese investments from China and move elsewhere.  He opined that it is an opportunity for India, which should not be missed.

IIHMR University hosted webinar on COVID 19 and Comorbidities in Indian perspective

20th May 2020: There is a strong association with smoking and severity of COVID-19. This is of importance because India is ranked second in the number of tobacco users and first in usage of smokeless tobacco. However in healthier adults, the body’s immune system can develop antibodies that fight off viral infections, but people with underlying medical conditions must be extra careful even if the lockdown is lifted as hypertension, obesity and diabetes were the most common Comorbidities among Covid-19 patients.” This was stated by Dr. Narayana Prasad, Technical Director, Cardiovascular Imaging Core Lab, Brigham, and Women's Hospital (Harvard Medical School Teaching Hospital) and Founder, www.public health literacy.org, Boston, MA USA, while explaining the criticalities among COVID 19 and Co-morbidities in Indian perspective. He was addressing a webinar conducted by IIHMR University, Jaipur, on ‘COVID 19 and Co-morbidities (Obesity, Heart Diseases and Hypertension) - From Public Health Perspective.’ The session was moderated by Dr. Piyusha Majumdar, Assistant Professor, IIHMR University, Jaipur.

According to a study conducted by AIIMS, New Delhi, Fortis Escorts Health Institute, New Delhi, and Mother Hospital, Kerala, one in three Indians suffer from Hypertension. He also referred the recent studies conducted by the US Centre for Disease Control (CDC) which analyzed the data of around 7,000 COVID-19 patients, found that 71 per cent of those who were hospitalized with the infection and 78 per cent of those who were admitted to ICUs had underlying medical conditions which implies that almost 90% of Covid-19 admissions involve Comorbidities.

Dr. Piyusha Majumdar, Assistant Professor, IIHMR University said, “As we all know that, first   three Indians who died of COVID-19, had underlying health conditions like diabetes, hypertension and asthma, that are believed to have compromised their fight against the disease. Although respiratory symptoms are the hallmark of COVID 19, this elusive coronavirus attacks the human body in other ways more than any other virus especially among those who have chronic diseases. The scientists across the world are working relentlessly to understand the nature of the disease, still the uncertainty and controversies continues.”

Hiral Bhatia a celebrity hairstylist been doing hair since the past 11 years. Eka Lakhani:

Eka Lakhani is a Mumbai based costume designer. Her journey in the world of fashion and costume started when she was very little as her father is a textile designer and she grew up in a world surrounded by the history of Indian textiles. She studied Diploma in Apparel Manufacture and Design from SNDT, Mumbai. She moved to New York briefly to brush her costume and international styling skills at the FIT, New York.

On returning, she had the opportunity to assist designer Sabyasachi Mukherjee in Mani Ratnam Sir’s film Raavan. This was a sort of turning point when she discovered her natural instinct to lean towards Indian traditional fashion and the Film Industry.

Post Raavan, at the age of 23, she did her first independent project as a Costume Stylist for Santosh Sivan Sir’s costume drama Urumi.

She won the Best Costume Designer award for her work in Mani Ratnam’s Chekka Civantha Vaanam, a director with she has worked closely for 10 years.
